User Agreement

The term "User" as used in this Service Agreement shall refer to any user who has registered on the website www.gti.sinoimex.com/sign or purchased the SINOIMEX series of network products, including but not limited to GTM, GTF, etc. This Agreement shall apply to all Users, including those utilizing trial and paid versions of the service.

I. User Rights and Obligations

1. Reasonable Product Usage

Users shall use GTI products in a lawful and appropriate manner. Usage is limited to normal data browsing, querying, and downloading. Except for the permitted downloading functionality, users may not use GTI products in any of the following ways without authorization, including but not limited to: scraping, caching, deploying plugins, reverse engineering, disassembling, decompiling, mirroring, or developing derivative works based on GTI products. We encourage users to adhere to reasonable operating practices to ensure system stability and security.

2. Account Security and Usage:

Users are responsible for safeguarding their account information. If any unusual account activity is detected (such as unusually frequent queries or suspicious login attempts), users should promptly notify the GTI team. We will actively assist in addressing the issue. To maintain system security, GTI reserves the right to suspend or terminate access to any account exhibiting abnormal behavior, when deemed necessary.

3. Renewal and Service Term:

Users are entitled to normal usage of GTI products and associated services during the service term. To ensure uninterrupted service, users should contact the GTI team to complete the renewal process before the service term expires. While we will make reasonable efforts to remind users about renewal, GTI assumes no responsibility for service interruptions resulting from a user's failure to renew their subscription in a timely manner.

4. Search Criteria and Result Accuracy:

The GTI system's search criteria are meticulously designed, allowing users to easily navigate the search process by simply following the system prompts. It's important to note that variations may exist in the scope of analysis, available indicators, and optional search criteria between the central "Original Database" and the regional "Provincial/State Databases." These variations are due to differing national statistical methodologies employed by each database and are expected. They do not impact the overall functionality of the system.

5. Scope of Data Use:

Users may utilize the data within the system as a reference tool for business decisions; however, they should incorporate their own professional knowledge and industry experience to make independent judgments. GTI product data supports user research and analysis but should not be considered a substitute for professional business consultation or legal advice. Users should exercise caution when using the data and avoid risks associated with misinterpretation or improper application. SINOIMEX shall not be held liable for any loss or damage incurred by users as a result of business judgments or decisions aforementioned made based on the use of GTI products.

6. Payment and Invoice Processing:

Users can purchase GTI services through designated payment methods and are entitled to receive corresponding invoices or receipts based on their payments. Users are responsible for ensuring the accuracy of invoice/receipt information provided. Any financial loss or other consequences arising from incorrect information will be borne by the user. We are committed to providing users with a satisfactory service experience.

6. Payment and Invoice Processing:

Users can purchase GTI services through designated payment methods and are entitled to receive corresponding invoices or receipts based on their payments. Users are responsible for ensuring the accuracy of invoice/receipt information provided. Any financial loss or other consequences arising from incorrect information will be borne by the user. We are committed to providing users with a satisfactory service experience.

II. SINOIMEX's Responsibilities and Disclaimers

1. Data Quality:

SINO shall exercise due diligence and make every effort to ensure the data's comprehensiveness, timeliness, and accuracy, and to provide the user with a complete product. However, SINOIMEX makes no explicit or implicit guarantees regarding the outcomes or effects that users may achieve through the use of the product.

SINOIMEX, in accordance with its duty of care, will provide clear instructions on data query conditions within the product design, including analysis scope or index filtering. When using Hanwen Information products, users are required to provide query conditions such as, but not limited to, country/economy name, HS code, time series, and currency. If the query conditions do not match the information in the database, the return value will be empty. This does not affect the completeness of the query service, and SINOIMEX will not be held responsible.

2. Intellectual Property

SINOIMEX ensures that its products and services fully comply with China's intellectual property laws in terms of data source collection and system development. SINOIMEX guarantees that it possesses full intellectual property rights or licenses for the products provided to users. SINOIMEX continually enhances and improves the features and services of its products. While SINOIMEX will make every effort to expand data sources and update them promptly, it does not guarantee that all data will be updated. For more details, please refer to Clause 4, "Force Majeure and Disclaimer."

III. Intellectual Property and Confidentiality

1. Ownership:

All rights to the software, data, and other assets used in operating SINOIMEX products belong exclusively to SINOIMEX. Users are obligated to protect SINOIMEX's intellectual property from any third-party infringement. Users may not use or copy any software or data related to SINOIMEX products, including system interface design, database design, interface layout, functionality design, analytical dimensions, data mining, and underlying data. Users must not allow third parties to steal SINOIMEX's software or data. Even after the termination of this agreement, both parties' obligations under this clause remain in effect.

2. Confidentiality Obligation:

SINOIMEX provides specialized technology and methods to assist users in utilizing SINOIMEX products. SINOIMEX retains the intellectual property rights to these technologies and methods, even if such rights have not been formally protected through national government applications. Users have a complete confidentiality obligation and may not disclose these technologies and methods to any third party, individual, or organization, even after the service period has ended.

IV. Force Majeure and Disclaimer

SINOIMEX shall not be held liable for any failure or inability to provide products or services due to force majeure. "Force Majeure" refers to events beyond the reasonable control of SINOIMEX that are unforeseeable or unavoidable even if foreseen, and which disrupt, affect, or delay the provision of services by SINOIMEX. Such events include, but are not limited to, government actions, major communication line failures, earthquakes, typhoons, floods, fires, wars, cyberattacks, computer viruses, pandemics, or other similar events.

Due to the vast geographical scope and diverse political and economic landscapes, SINOIMEX reserves the right to modify the country coverage of its product data sources, or specific country database projects, in response to policy adjustments, regulatory revisions, or other governmental actions by the countries from which the data originates. SINOIMEX does not guarantee the continuous update of all data.
